It is possible to aquire a flag from another player, or produce one at a building, but be unable to use it because you aren't in an empire.
Maybe it would be useful if the "use action" of a flag also opened the "create empire" dialog.
Before doing any other checks, just check if the avatar is part of an empire, if not then open the dialog instead of any claiming.
Currently a "free avatar" with a flag is simply unable to use it at all. No message is shown when attempting to claim or anything.
